At Radio Free Libya, change is on the air

By Hannah Allam | McClatchy Newspapers

TOBRUK, Libya — Before going live for the first time since this eastern Libyan city broke free from Moammar Gadhafi's rule last week, staff members of the local radio station took a moment to calm their nerves.
They agreed to speak in sober and reassuring tones, but Anwar Sherif, the station's main announcer, couldn't contain himself once he took the microphone to deliver the city's first free broadcast in 42 years.
"There was a fear barrier broken that day. I sounded sentimental, even hysterical," Sherif, 36, recalled Thursday. "We let loose all the words we could never say. I said, 'Down with the tyrant!' and then all the other suppressed words came spilling out."
Tobruk's Radio Free Libya was among the first three stations in the country to offer uncensored updates on the revolt against Gadhafi's regime, which still controls the capital, Tripoli, and most of the western part of this restive North African nation.
Once supervised by in-house intelligence agents who had the final say over every program, the radio station is now the mouthpiece of anti-government rebels who have few other conduits to the masses because the old state-run newspapers have stopped publishing, and the regime has shut down the Internet and most cell-phone service throughout the country.
A month ago, the most controversial topic on air was the locals' frustration over the lack of promised development projects, residents now call in to ask where they can donate food and medical supplies — their contributions to the struggle to unseat Gadhafi.
On Thursday, Radio Free Libya aired security updates, along with pleas to stand in solidarity with the besieged people of the capital, Tripoli. Another program took aim at price gouging, with the announcer declaring that any driver or merchant who overcharged people because of the crisis "has no sense of patriotism."
The imam of the city's biggest mosque issued a plea through the station for young men in the area to return all the heavy weapons they'd seized in clashes with security forces. He said Libyans were grateful to the youth for their bravery, and urged prayers for the dead.
"I hail the people who were martyred in this revolution, and may God give them mercy," the imam said over the crackly airwaves. "Paradise awaits all those who received bullets in their chests."
This sudden, free flow of information is still hard to absorb for the radio station's 32-person staff, which saved the most vital equipment only hours before the station's old headquarters was torched on Feb. 18. They began broadcasting again Sunday in a ramshackle building near a communications tower, the location of which they don't want revealed in case of government retaliation.
"Radio Free Libya" is scribbled in black marker on the front door. The studio is a dingy room furnished with only a soundboard and a desk for the microphones. Nobody's receiving a salary anymore. But for the journalists who no longer have to stick to Gadhafi's party line, this new space is a laboratory for their long-crushed dreams.
"We're going to be the fourth estate," said Khaled Mahmoud, 36, an announcer. "Before Feb. 17, it was a one-sided game. But we will build a free media that broadcasts events in a neutral, objective way."
Before the uprising, the university-educated, politically astute staff members said they were stifled by the regime's strict edicts on suitable programming. That mostly meant praise for Gadhafi and his family interspersed with a smattering of folkloric music and cultural shows. When the seeds of the uprising began a month ago, around the time of similar revolts in Tunisia and Egypt, the government banned all live broadcasts in case a dissident announcer attacked Gadhafi on air.
"The intelligence officers would say, 'You have to go with the policy of the country, and don't ever criticize the regime,'" said programming coordinator Abdullah Idris, 42. "They were in our building, watching everything."
When protests in the downtown square turned into violent clashes with the security forces on Feb. 17, the station's employees immediately sided with the demonstrators. The opposition, backed by army defectors, overwhelmed Gadhafi's forces that day, and the old radio format ended overnight.
The station was off the air only one day before returning as Radio Free Libya. The staff members, who come from six of the area's most prominent tribes, said their goal is to create a station that promotes national unity and gives voice to the grievances of the people. And they said they wouldn't go easy on whatever government emerges from the current turmoil.
"Libya will surprise the whole world with our media," said Saleh Wafi, 42, a producer. "We are cultured and educated. All we lacked was freedom."

Prima emittente libica "liberata"

Bielorussia, raid nelle emittenti e ritorsioni odiose

64TH EBU General Assembly Baku, Azerbaijan

Declaration on freedom of expression, media independence and democracy

2 July 2010

Context

The EBU’s 64th General Assembly, held in Baku, Azerbaijan, at the invitation of the national broadcaster Ictimai, focused in particular on two key principles of public service media: freedom of expression and information, and freedom and pluralism of the media. The EBU has defended these principles, and their corollary, the editorial independence and institutional autonomy of public service media, ever since its foundation 60 years ago, and they are enshrined in Article 1 of the Union’s Statutes.(1)

Following discussions in the General Assembly on how to guarantee and enhance impartial reporting and quality journalism, the 150 delegates adopted the following declaration:
- The EBU calls for freedom of expression and freedom and pluralism of the media to be respected everywhere, and specifically in all countries represented in the EBU’s Membership(2), in line with the Council of Europe's European Convention on Human Rights (Art 10).

The EBU notes that:

- The right to freedom of expression and information takes precedence over political or economic interests, and States have a duty to ensure and protect this fundamental cornerstone of democracy,

- All members of the Council of Europe, including Azerbaijan, have committed themselves to respect the European Convention on Human Rights(ECHR),

- Azerbaijan’s media laws aim to ensure greater media freedom in the country than in the past, and the establishment of Ictimai following Azerbaijan’s admission to the Council of Europe has helped to improve the quality of journalism.
However, reflecting concerns expressed by its Members, the EBU:

- Condemns arrests, harassment and intimidation of journalists and calls upon governments to investigate all instances of violence against journalists and bring to justice those responsible;

- Calls on authorities to respect the rulings of the ECHR and to resolve all cases against journalists through fair, transparent procedures in line with international legal standards(3);

- Demands that legislators and authorities develop amendments to the criminal code so as to decriminalize defamation, and to refrain from bringing any new criminal prosecutions against journalists for defamation;

- Calls upon all governments to take concrete steps to create an environment conducive to freedom of expression, including by preventing the abuse of defamation laws and other legal provisions to silence critical voices;

- Calls on all governments to avoid undue government regulation and interference with freedom of expression, and stresses that censorship and jamming of broadcaster signals have no place in a democratic society;

- Urges governments to create conditions for freedom of expression on all media platforms, to ensure impartial and independent journalism, including reporting by independent journalists, and full and open democratic debate without interference from authorities or fear of violence or other forms of intimidation;

- Recalls that the Internet and social media networks are crucial to media pluralism in a democratic society and urges all governments to respect the freedom of individuals to express themselves through these networks.(4)

The EBU recognizes further that media freedom must go hand in hand with media responsibility and with journalists acting in line with our professional standards and values.

It pledges to support the development of fair and balanced quality journalism within Ictimai, as also within all its other Members, through the organization of training, professional discussion and the exchange of best practices.

Finally, the EBU supports its Members unreservedly in ensuring that the principles contained within this declaration are respected in their countries.

L'OSCE chiede più libertà di stampa. In Armenia e Italia

OSCE media freedom representative urges Italy to amend bill on electronic surveillance

VIENNA, 15 June 2010 - The OSCE Representative on Freedom of the Media, Dunja Mijatovic, today called on Italy to drop a draft law on electronic surveillance - also known as the 'wiretap law'- backed by the Italian government or revise it to bring amendments in line with international standards of freedom of expression and OSCE commitments.
On 10 June, the Italian Senate passed the bill on electronic surveillance and electronic eavesdropping (Law No. 1611) in a controversial vote boycotted by opposition senators.
"I am concerned that the Senate approved a bill that could seriously hinder investigative journalism in Italy despite several warnings from my Office. It marks a trend towards criminalizing journalistic work," said Mijatovic.
"Journalists must be free to report on all cases of public interest and must be able to choose how they conduct a responsible investigation. The draft law in its current form contradicts OSCE commitments, especially as it prohibits the use of some confidential sources and materials which may be necessary for meaningful investigative journalism in the service of democracy," Mijatovic said.
According to Mijatovic, problematic amendments of the draft law include:
Severe restrictions on the publishing of documents related to court proceedings or police investigations prior to the beginning of a trial;
The introduction of a penalty of up to 450,000 euros for publishers and 30 days in jail and a penalty of up to 10,000 euros for journalists who publish leaked wiretapping materials before the beginning of a trial;
The possibility of a prison sentence for anyone who is not a "professional journalist" who records or films a person without their prior approval.
The amendment still needs to be approved by the lower house of parliament and signed by the President of Italy to become law.

Partinico-Bologna, 25 marzo 1970-2010

Stampa in libertà (vigilata)

Two female indigenous radio station broadcasters murdered in ambush of crew in Oaxaca

Target(s): radio station(s) , journalist(s)

Urgency: Flash

(ARTICLE 19/CENCOS/IFEX) - Two announcers of La Voz que Rompe el Silencio community radio station, which is based in San Juan Copala, Oaxaca state, in southeast Mexico, were shot dead when traveling on the highway connecting Joya del Mamey to Putla de Guerrero, two settlements in Oaxaca. Dead are Felicitas Martínez Sánchez, 21, and Teresa Bautista Merino, 24. Four other people were wounded.
According to information released by the Centro de Apoyo Comunitario Trabajando Unidos A.C. (CACTUS) - a civil society organisation that works in the area, the ambush took place between 1:00 and 2:00 p.m. (local time) on 7 April 2008. According to media reports, the police found at least 20 spent AK-47 bullet cartridges at the scene of the crime.
La Voz que Rompe el Silencio has been broadcasting since January 2007, the date of the first anniversary of the declaration of the autonomous municipality of Copala. The majority of the people involved in the project are young adults and teenagers from the Triqui indigenous community.
CACTUS human rights work coordinator Omar Esparza indicated that "the group had gone out to do reporting and interview people. They were indigenous reporters carrying out a task assigned by the community authorities."
"It's a pity that no one paid attention to the complaints we had been making about the critical situation in the region for the last five months," Esparza added.
The region has been wracked by intense political confrontations, especially since the Triqui people's authorities and organisations declared the creation of an autonomous region of San Juan Copala, 350 kilometers from Oaxaca's capital, in January 2007.
This attack comes in the wake of a long list of attacks on journalists in Oaxaca, which highlights the unsafe conditions in which they are obliged to exercise their rights to free expression and press freedom. Community radio stations are at particular risk, as demonstrated by the previous assaults on members of Radio Nandia and Radio Calenda radio stations, also based in Oaxaca. The attacks on both of those radio stations and their staff are still unpunished.
ARTICLE 19 and CENCOS once again respectfully urge the Mexican state to take every measure, both legislative and political, to ensure both the physical safety and freedom from legal harassment of people exercising their rights to free expression and press freedom, in accordance with the state's international obligations and international human rights standards.

Sopravvivere - come giornalisti liberi -in Colombia

Presentazione libro Sotto pressione Il giornalismo in Colombia prigioniero di guerriglia, narcotraffico, paramilitari e governo Mercoledì 9 aprile 2008 – Ore 21.00 Palazzo Isimbardi (Sala Affreschi) via Vivaio 1, Milano

Radio commentator killed

ZAMBOANGA CITY: Malacañang [il palazzo presidenziale filippino, come dire, la Casa Bianca, o la Casa Rosada, NdR] has ordered investigation of the murder of Ferdie Lintuan, a Davao City-based radio broadcaster shot dead in a daring broad daylight attack in the southern Philippine port city of Davao on Monday.
Police said Lintuan, a commentator of radio DXGO, was with two other media men in his car when ambushed and killed by still unidentified men just outside the radio station where he was working. He was instantly killed in the attack that occurred around 10 a.m.
Malacañang has directed the Philippine National Police (PNP) and the National Bureau of Investigation (NBI) to conduct the probe of the killing of a Davao City broadcaster on Monday. In a text message, Jesus Dureza, presidential adviser on the peace process, said the government will not allow perpetrators of the killing go unpunished, appealing to the members of Davao media organizations to help the victim’s family.
“We condemn the murder of Davao radioman Ferdie Lintuan who was shot in his car as he stopped at the junction. He came from [his] radio program at station DXGO. Two media companions Lucio Ceniza and Edgar Banzon were not hurt,” Dureza said in his message. “We are asking the police and the NBI to investigate this. The government will not allow this criminal act to go unpunished. We are coordinating with Davao media groups in providing assistance to the grieving family. Lintuan, a widower, is taking care of four school-aged children.”
“We still don’t know the motive [behind] the killing,” policeman Anthony Suniel told The Manila Times by phone from Davao City. “There is an investigation going on.”
Lintuan’s killing was condemned by the National Press Club and the Alyansa ng Filipinong Mamamahayag. No other details of the Lintuan killing were made available by the police, but extrajudicial killings are rampant in Davao, where several journalists also had been murdered in the past. Among them were Ed Palomares, Cezar Magalang, Narciso Balani and Rogie Zagado in 1987 and Juan Pala Jr. in 2003.
The Press Club noted that Lintuan’s cold-bloodied death came on the heels of the ambushes in Davao on two more hard-hitting radio commentators, Armando “Rachman” Pace and Jun Pala. Recently, three journalists—broadcaster Alexander Adonis and newspapermen Roger Flaviano and Tony Figueroa—in Davao were convicted of libel for working true to the definition of press freedom. In addition, media men working in Davao complained of numerous death threats faced by some of them. Last week, freelance journalist Romelito Oval Jr., was also killed and his body buried in a shallow grave on a remote village in Butuan City, Agusan del Sur province, also in the southern Mindanao region. To date, more than 900 persons have been killed and hundreds missing since President Gloria Arroyo took office in 2001, according to the United Methodist News Service. Among the victims are dozens of lawyers, judges and church leaders.
In October, a Filipino broadcaster, Jose Pantoja, was shot and seriously wounded in front of the Mindanao State University in Iligan City, Lanao del Sur province. The attacker fled after the shooting. In August, unidentified gunman also shot and wounded another broadcaster, Manuel Kong, of the radio station DXSN, in Surigao City, Surigao del Sur province.
Five journalists have been killed and two others wounded in separate attacks in the Philippines since early this year, according to the nongovernment National Union of Journalists of the Philippines (NUJP), an affiliate of the International Federation of Journalists (IFJ). Last week, the Federation hailed the arrests of two suspects in the 2001 murder of Rolando Ureta, a radio journalist in Aklan province.
It said the arrests of Jessie Ticar and Amador Raz “underline why it is so important that police continue to investigate crimes against journalists in order to ensure that attackers are brought to justice and no longer pose a threat to the media and to all of society.” The Federation represents more than 600,000 journalists in 120 countries.
“The IFJ joins the NUJP in welcoming the arrests and moves by the police and the courts to pursue cases of felony against journalists. The action should send a message that perpetrators of crimes against journalists will indeed be punished in accordance with the law,” said the Federation in a statement released through National Union of Journalists in the Philippines.
Ticar surrendered to the police on December 18, announcing his surrender on air while being interviewed over radio station dyKR in Aklan’s provincial capital Kalibo, the same station were Ureta worked as program director and anchorman before he was gunned down on January 3, 2001. Raz was nabbed on November 26 in Numancia town on the strength of a warrant issued on November 21 by Judge Marietta Homena-Valencia, presiding judge of Branch 1 of the Kalibo Regional Trial Court.
The lone witness, Gerson Sonio, has tagged Ticar and Raz as the ones who shot Ureta dead along the national highway in Barangay Bagtu, Lezo town, about seven kilometers west of Kalibo. The suspects have repeatedly denied involvement in the killing and questioned the credibility of Sonio. Ureta had hosted the nightly program Agong Nightwatch and was investigating the proliferation of illegal gambling and illegal drugs in the province when he was killed.
While it welcomed the recent arrests, the International Federation of Journalists said Philippine authorities should exert more effort to solve the murders of other journalists in the country. It cited a 2007 report of the Federation and Union “Confronting the Perils of Journalism in the Philippines” that recorded 90 cases of murder of journalists or media workers in the Philippines over 20 years. Of the cases, the report said, only three perpetrators have been convicted and only eight cases remain active. “The performance of the Philippines police, courts and judicial system must dramatically improve if fear-mongering and violence against journalists are to subside,” said the Federation’s Asia Pacific director, Jacqueline Park. The Philippines is branded, after Iraq, as one of the most dangerous work places for journalists because of its history of unresolved killings of journalists. Dozens of journalists have been killed in recent years, and most cases remain unresolved.
